CONTEST DATES. The Homes.com Fabulously Festive Olioboard Design Contest (the “Promotion”) begins at 09:00:00 a.m. Pacific Standard Time (“PST”) on November 21, 2013 and ends at 09:00:00 a.m. Pacific Standard Time (“PST”) on December 12, 2013 (the “Promotion Period”). The Promotion Period consists of four (4) phases as set forth in the chart below:

Homes.com is the official time-keeping device for the Promotion.
ELIGIBILITY REQUIREMENTS: The Promotion is open to legal residents of the fifty (50) United States and the District of Columbia who are age eighteen (18) years old or older (or the age of majority in their state or residence) as of the date the contest begins. This offer is void wherever prohibited or restricted and subject to all applicable federal, state, and local laws. Residents of the state of Rhode Island are not eligible to win. Employees and their immediate family (parent, child, sibling and spouse of each) and individuals residing in the same household (whether or not related) of Homes.com, Dominion Enterprises, Landmark Media Enterprises, LLC and any of their affiliates, subsidiaries, advertising and promotion agencies, and all other entities or individuals associated with the development, administration, or fulfillment of the Promotion are not eligible to participate or win. All applicable federal, state and local laws and regulations apply. This Promotion consists of a contest of skill (the “Contest”).
AGREEMENT TO OFFICIAL RULES. By participating in the Promotion, the participant (“Entrant”) fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor and/or Administrators, which are final and binding in all matters related to the Promotion. The award of a prize is contingent upon Entrant complying with all conditions and fulfilling all requirements set forth herein.
HOW TO ENTER:
THE CONTEST OF SKILL. A degree of skill is required to win. During the Contest Period phase (Phase I) visit the website, www.olioboard.com or blog.homes.com (the “Website”) and follow the instructions to submit an original Olioboard design board (‘the Entry” or “Entries”) creatively showing how you would decorate your space for the holidays. The Entry must comply with the following requirements to be eligible:
To enter in the Homes.com Fabulously Festive Olioboard Design Contest, visit olioboard.com and create a free account. Setting up your account requires a username, email address and password. Once your account is created, go to the contest page and click the ‘create a new Olioboard’ button in the top right of the screen. Once the Moodboard Creator is open, you can pull items onto your “canvas” to create your design. You must include at least one image from the Homes.com Holiday Set for your entry to be eligible to win.Save your Olioboard by hitting the “Save” button in the top right of the screen. To add your design to the Contest, go to the Contest page and click the “Add an Entry” button. From there you can select the board you wish to enter into the contest by clicking the “Add to Contest” link under the board’s image. Entrants may enter multiple boards.
Voting will take place through the duration of the Contest. Anyone can sign-up for an Olioboard account and vote in the contest. On the contest page you will see heart icons below each entry. Click on the heart icon to vote for your favorite entries. You can vote for as many boards as you like but each board can only receive one vote per day. At the end of the contest (Dec 12th 2013 at 9am PST) the top 50 voted boards will be reviewed by an internal judging panel and the winning boards will be announced on or around Dec 16th 2013.
By entering the contest, the entrant hereby represents and warrants that the work does not and shall not infringe on any copyright, any rights of privacy or publicity of any person, or any other right of any third party, and that the entrant has the right to grant any and all rights and licenses granted to Olioboard herein, including but not limited to all necessary rights under copyright, free and clear of any claims or encumbrances.
The entrant understands and intends that any work submitted by the entrant to olioboard.com may be available for viewing, rating, reviewing and commenting on by the public, and understands that comments or ratings with which the entrant disagrees or is unhappy about, may be published or otherwise become associated with any work the entrant submits to olioboard.com. By submitting any work to olioboard.com, the entrant hereby waives any privacy expectations that the entrant may have with respect to any such work submitted by the entrant to olioboard.com. (See also “Rights in the Entry”.)
Entrants may not enter the Contest with multiple email addresses or under multiple identities. Incomplete and/or duplicate Entries are not permitted and will be deemed void. The use of any device to automate the entry process is absolutely prohibited, and any such Entries shall be void.
USE OF TRADEMARKS AND SLOGANS. For the sole purpose of participation and entry in this Promotion, Sponsor hereby grants each Entrant a non-exclusive, royalty-free license to use the trademarks and copyrights owned by Sponsor in the creation of the Entry, subject to the entry restrictions and guidelines contained in these Official Rules. This license extends only to Entries submitted to Sponsor in accordance with these Official Rules. This license does not extend to Entries created in connection with the Promotion, but not submitted to Sponsor in accordance with these Official Rules. Use of trademarks, copyrights, and other intellectual property owned by Sponsors in any form of media not submitted to Sponsor in connection with this Promotion and in accordance with these Official Rules constitutes an unauthorized use and infringement of the intellectual property rights of Sponsor. Sponsor hereby reserves all rights and remedies available to Sponsor at law or in equity to enforce these Official Rules, including, but not limited to, the enforcement of any trademark, copyright, and other intellectual property rights owned by Sponsors.
SELECTION OF FINALISTS AND WINNER. At the conclusion of the Promotion Period, Sponsor will post the finalists’ Entries in compliance with the Official Rules at www.olioboard.com or blog.homes.com on or around December 12, 2013. All Entries will be reviewed for content before being posted on the Website. Entries submitted may or may not be posted on the Websites, in the sole and absolute discretion of Sponsor. Sponsor shall have absolutely no obligation to give feedback or reasoning for why any Entry is not posted on the Website. Sponsor shall have the sole right to reject or remove an Entry from the Websites at any time.
From 09:00:00 a.m. PST on November 21, 2013 to 09:00:00 a.m. PST on December 12, 2013, the public may vote on those videos (boards) posted on the Website at www.olioboard.com by visiting the Website and following the voting instructions. Limit: Each user may vote one (1) time per board, each day during the Voting Phase. Additional votes for a single Entry submitted by the same verified e-mail address on the same day will be disqualified.
The top 50 finalists will be selected based on receiving the greatest number of votes and based on followed eligibility requirements. In the unlikely event of a tie for the top 50 finalists, both will be included as finalists.
JUDGING: Contest finalists will be selected according to the following judging criteria:
- 35% Creativity and originality
- 25% Relevance to contest theme
- 20% Follow contest instructions
- 20% Presentation of image/quality
Grand Prize, second and third place winners will be selected from the pool of 50 finalists based on the above criteria.
On or about December 16th, 2013 Sponsor’s internal panel of judges will choose (1) Grand Prize Winner, one (1) second place winner and one (1) third place winner.
PRIZES:
a) ONE (1) GRAND PRIZE: One winner will receive $1,000 gift card. Approximate Retail Value (“ARV”): $1,000.
b) ONE (1) Second Place prize: One winner will receive $500 gift card. Approximate Retail Value (“ARV”): $500.
c) ONE (1) Third Place Prize: One winner will receive $250 gift card. Approximate Retail Value (“ARV”): $250.
All federal and state taxes on prizes are the sole responsibility of the winners. The winner acknowledges that the prize is taxable and agrees to provide information for, and verify by signature, the appropriate IRS and other forms as determined by Sponsor. No transfer, assignment, cash redemption, or substitution of a prize is permitted except that Sponsor reserves the right, in its sole and absolute discretion, to substitute a prize (or portion of a prize) with a prize of comparable or greater value or cash value. In the event that a prize cannot be awarded for any reason or a winner is not capable of redeeming a prize for any reason, Sponsor shall not be obligated to award any prize. If, for any reason, more than the stated number of prizes are available and/or claimed, Sponsor reserves the right to award the prizes in such category to a runner up.
HOW TO CLAIM PRIZE. The winner will be contacted within the week following the end of the contest using the email address in their Olioboard account. If a potential winner does not respond within 7 days of notification, the prize will be forfeited and another winner will be chosen. Winners will be notified within 7 business days by email of their prize amount. Winners will be required to complete, sign, and return an Affidavit of Eligibility and, where lawful, a Liability/Publicity Release within ten (7) business days of receipt of notice of such winning status in order to accept and receive the prize. If the indicated forms are not signed and returned by the time indicated on the documents, or if a Prize Winner does not meet the eligibility criteria, declines the prize, cannot be contacted within the time frames set forth herein, or is otherwise unwilling or unable to comply with these Official Rules, an alternate Prize Winner may be selected at and in a manner to be determined in Sponsor’s sole and absolute discretion.
RIGHTS IN THE ENTRY. All contest entries automatically become the property of Olioboard and Homes.com. By submitting any entry to olioboard.com, the entrant hereby grants Olioboard and its affiliates, subsidiaries, licensees and assigns, an irrevocable, perpetual and royalty-free right to use, reproduce, edit, display, transmit, prepare derivative works of, modify, publish and otherwise make use of the entry in any and all media, whether now known or hereinafter created, throughout the world and for any purpose. In addition to other things, the rights granted to Olioboard include but are not limited to the right to resize, crop, censor, compress, edit, feature, caption, affix logos to, and to otherwise alter or make use of the submission.
Entrants hereby agree to hold Homes.com, Olioboard.com Interactive Inc. and its affiliates, subsidiaries, licensees, sponsors, officers, directors, employees and assigns harmless from and against, and hereby waive any right to pursue, any claims of any nature arising in connection with the inclusion in, publication via or display on olioboard.com, or any other use authorized under these Terms, of any entry submitted to olioboard.com by the entrant. Entries submitted by entrants to olioboard.com shall be the property of olioboard.com and shall have no obligation to preserve, return or otherwise make available to the entrant or others any entry so submitted. All Entries (including all material embodied therein) submitted to Sponsor shall automatically become the sole and exclusive property of Sponsor immediately upon submission. Once an Entry has been submitted pursuant to the Promotion, the Entrant may not distribute, disseminate, sell, use, license, or post the Entry or any copies thereof in any medium (including other Internet sites) without the prior express written consent of Sponsor. Each Entrant, as a condition of participation in the Promotion, hereby grants Sponsor the exclusive, perpetual, worldwide right to edit, adapt, modify, reproduce, publish, distribute, and otherwise use (unless prohibited by applicable law) the Entry (including all material embodied therein) in any way or in any media now or hereafter known for trade, advertising, promotional, or other purposes as Sponsor determines, in its sole and absolute discretion, without further notice or compensation to the Entrant or any other third parties. Nothing herein shall be construed to require Sponsor to publish, distribute or in any way use the video (entry)(or any of the material embodied therein) should Sponsor in its sole discretion decline to do so.
PRIVACY AND PUBLICITY. Sponsor will collect personal data from Participants, and this information may be used for the purposes of administering the Promotion, publicizing the Promotion, and other promotional purposes that benefit the Sponsor. Unless prohibited by law, participation in the Promotion constitutes each Entrant’s consent for Sponsor to use the Entrant’s name (or username for Promotion or promotional purposes in any media now known or later developed, without payment or consideration to the Entrant. You are providing your information to Olioboard and Homes.com.
GENERAL RELEASE AND WAIVER OF CLAIMS. By entering the Promotion and/or accepting a prize, each Entrant (for himself/herself and his/her heirs) hereby releases and indemnifies Olioboard and Homes.com Sponsor, the Entities, and all of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, and all of their respective directors, officers, governors, employees, shareholders, and agents (collectively, the “Releasees”) from any and all liability, loss, harm, damage, cost, expense, or claims including, but not limited to, third party claims based on: (i) publicity and/or privacy rights, defamation, and intellectual property associated with the Entrant or winner’s participation in the Promotion, redemption of any prize in connection with the Promotion, and/or use or misuse of any prize in connection with the Promotion, including, but not limited to, all reasonable counsel fees and court costs incurred, property damage, personal injury, and/or death; (ii) anything related to the production, promotion, or execution of the Contest (or participation therein), including preemption, cancellation, or rescheduling; and (iii) anything that may occur in connection with acceptance and/or use of the prizes or while participating in the Promotion, even if caused or contributed to by the negligence of Releasees.
LIMITATIONS OF LIABILITY. Neither Sponsor nor any other Releasee shall be responsible for non-conforming, lost, late, stolen, misdirected, illegible, or incomplete entries. Neither Sponsor nor any other Releasee shall be responsible for any incorrect or inaccurate information, whether caused by Sponsor, Releasees, Entrants, tampering, or by any of the equipment or programming associated with or utilized in the Promotion, and neither Sponsor nor any Releasee shall assume responsibility for any error, omission, defect, theft, destruction, or unauthorized access to the materials related to the Contest, or for any damage to the Entrant’s computer related to or resulting from participating in the Promotion. Sponsor reserves the right, in its sole and absolute discretion, to disqualify any individual found to be tampering with the entry process, the voting process, or the operation of the Promotion; to be acting in violation of these Official Rules; or to be acting in a non-sportsmanlike or disruptive manner; or with intent or apparent intent to annoy, abuse, threaten, embarrass, harm, or harass, in any way, any other person. If for any reason the Promotion is not capable of running as planned by reason of, but not limited to, business or market circumstances, force majeure, public health concerns, tampering, unauthorized intervention, actions by entrants, fraud, or any other causes which, Sponsor in its sole and absolute discretion, deems could corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Promotion, Sponsor reserves the right, in its sole and absolute discretion, to cancel, terminate, modify, or suspend the Promotion or any portion thereof by posting a notice on the websites. If the Promotion or any portion of the Promotion is terminated before the end of the Promotion Period or the Voting Period, Sponsor will select winner from all eligible entries received as of the termination date of the Promotion. All prizes are provided “as is” without warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
MISCELLANEOUS. By entering this contest, entrant agrees to the Terms & Conditions of use and Privacy Policies posted on the Olioboard and Homes.com websites. This Promotion will be administered in the State of Virginia, and by participating, all Entrants hereby agree that the laws of the State of Virginia will apply exclusively to the Promotion and that any dispute with respect to this Promotion will be resolved in either the federal or state courts located in the State of Virginia.
